George Goodson was convicted of larceny, and he appeals. Affirmed.

HIGBEE, C.

The defendant was convicted of the crime of larceny and sentenced to a term of two years in the penitentiary, from which judgment and sentence he has appealed.

The transcript filed in this court contains what purports to be the bill of exceptions filed in the cause. It is not signed by the judge. Section 1459, R. S. 1919, requires that the bill of exceptions, if true, shall be signed by the person composing the court. Bills of exceptions in criminal cases "shall be settled, signed, sealed and filed as now allowed by law in civil actions." Section 4039, R. S. Not having been signed by the judge, it is not a bill of exceptions. State v. Watts, 248 Mo. 494, 496, 154 S. W. 721, and cases cited. Our review is therefore limited to the record. State v. Bowman (Mo. Sup.) 213 S. W. 97.

Finding no error in the record, the judgment is affirmed.
