State v. Hires

Decision Date06 December 1922
Docket NumberNo. 3200.,3200.
Citation245 S.W. 573
PartiesSTATE v. HIRES
CourtMissouri Court of Appeals

Appeal from Circuit Court, Taney County; Fred Stewart, Judge.

Frank Hires was convicted of selling intoxicating liquor, and he appeals. Affirmed.

W. R. Adams and D. F. McConkey, both of Forsyth, for appellant.

BRADLEY, J.

Defendant was charged by indictment with selling a quart of whisky in Taney county on the ____ day of September, 1920, in violation of the local option law in force in said county. On trial he was convicted, and fined $500, from which conviction he appealed.

The evidence tended strongly to show that defendant sold a quart of whisky to Floyd Robertson at the time alleged. Robertson so testified, as did another witness, and the jury believed them. We have examined the different grounds set up in the motion for a new trial, but find no room for substantial complaint. The instructions covered the issues, and defendant was accorded a fair trial.

The judgment should be affirmed; and it is so ordered.

COX, P. J., and FARRINGTON, concur.
