SYKES would affirm; Chief Justice SHIRLEY S. ABRAHAMSON, Justice WILLIAM A. BABLITCH, and Justice DAVID T. PROSSER would reverse. Justice ANN WALSH BRADLEY did not participate.

¶ 2. Accordingly, the decision of the court of appeals is affirmed.
