Appeal from superior court, Lenoir county.

D. G. Taylor was convicted, under Code, § 1005, of carrying concealed weapons, and sentenced to the common jail for four months, and to pay a fine of $200, and appeals. Remanded for sentence.

Where, on conviction, defendant is sentenced to fine and imprisonment, instead of fine or imprisonment, the case will be remanded for proper sentence.
