Appeal from Supreme Court, Appellate Division, First Department, 18 A.D.2d 121, 238 N.Y.S.2d 379.
Action by judgment creditor of insured under automobile policy to recover amount of judgment from insurer.
The Supreme Court, New York County, 227 N.Y.S.2d 999, Rocco A. Parella, J., rendered judgment for plaintiffs, and defendant appealed.
The Appellate Division, Botein, P. J., modified the judgment insofar as it exceeded the policy limits and otherwise affirmed, and a further appeal was taken.
