Appeal, on constitutional grounds, from an order of a Special Term of the Supreme Court for the county of New York, entered February 13, 1931, which denied a motion by the plaintiff for a peremptory order of mandamus to compel the municipal civil service commission of the city of New York to recall, annul, and cancel the certification for appointment of a disabled veteran to the position of court attendant on the ground that section 6 of article 5 of the State Constitution, providing for preference for disabled veterans in appointments in the civil service of the state and of civil divisions thereof, is repugnant to provisions of the Federal Constitution (Amendment 14), in that it denies to others the equal protection of the laws and abridges the privileges or immunities of such citizens.
