On review of submissions pursuant to section 500.4 of the Rules, order affirmed, without costs. It cannot be said, as a matter of law, that the Appellate Division (99 A.D.2d 949, 472 N.Y.S.2d 637 reversing 117 Misc.2d 991, 459 N.Y.S.2d 666) abused its discretion in dismissing the complaints pursuant to CPLR 327.
