Borrer v. State
Decision Date | 29 May 1901 |
Parties | BORRER v. STATE. |
Court | Texas Court of Criminal Appeals |
Appeal from district court, Kerr county; I. L. Martin, Judge. Lula Borrer was committed for contempt, and she appeals. Dismissed.
Robt. A. John, Asst. Atty. Gen., for the State.
This is an appeal from a commitment for a contempt, the contempt consisting in the refusal of the appellant to answer certain questions propounded to her as a witness. This is not a proceeding from which an appeal will lie, and consequently this court has no jurisdiction as an appellate tribunal. Crow v. State, 24 Tex. 12; Ex parte Kilgore, 3 Tex. App. 247; Carter v. State, 4 Tex. App. 165. However, if we had jurisdiction by appeal of cases of contempt, the jurisdiction would not attach in this case, because it is not made to appear that appellant is in custody pending her appeal. The appeal is dismissed.
