much of an order of the Supreme Court, Queens County (Weiss, J.), entered April 29, 2015, as denied those branches of its unopposed motion which were pursuant to CPLR 3215 for leave to enter a default judgment against the defendant Dominick Frantellizzi, individually, upon his failure to appear or answer the complaint, and for an award of an attorney's fee.

ORDERED that the order is modified, on the law, by deleting the provision thereof denying that branch of the plaintiff's motion which was pursuant to CPLR 3215 for leave to enter a default judgment against the defendant Dominick Frantellizzi, individually, and substituting therefor a provision granting that branch of the motion; as so modified, the order is affirmed

insofar as appealed from, without costs or disbursements.
