| Parties | Joseph P. HENRY, Appellant, v. Lori GUTENPLAN, Respondent. |
| Court | New York Supreme Court — Appellate Division |
Kenneth J. Molloy, East Islip, for appellant.
Berwin Leighton, New York City(Jeffrey E. Glen, of counsel), for respondent.

JoCarl Realty, Cor., 20 A.D.2d 664, 246 N.Y.S.2d 542).Further, we find no reason to disturb the court's implicit finding that the plaintiff's attorney had the authority to bind his client to the stipulation discontinuing the present action (see, Hallock v. State of New York, 64 N.Y.2d 224, 230, 485 N.Y.S.2d 510, 474 N.E.2d 1178;cf., Rivera v. Triple M. Roofing Corp., 116 A.D.2d 561, 497 N.Y.S.2d 416).
We have examined the plaintiff's remaining contentions and find them to be...
