People v. Simone
Decision Date | 06 May 1976 |
Parties | , 351 N.E.2d 432 The PEOPLE of the State of New York, Respondent, v. Frank SIMONE, also known as Gerald Christy, Appellant. |
Court | New York Court of Appeals Court of Appeals |
David J. Gottlieb and William E. Hellerstein, New York City, for appellant.
Robert M. Morgenthau, Dist. Atty. (Norman Barclay and Peter L. Zimroth, New York City, of counsel), for respondent.
Since the record discloses no more than 'mere whim, caprice, or idle curiosity' for the stop of defendant's automobile, the physical evidence seized as a result thereof should have been suppressed (People v. Ingle, 36 N.Y.2d 413, 420, 369 N.Y.S.2d 67, 330 N.E.2d 39).
Accordingly, the order of the Appellate Division, 48 A.D.2d 497, 370 N.Y.S.2d 583 should be reversed, the plea vacated, and the indictment dismissed.
Order reversed, etc.
