Appeal from Supreme Court, Appellate Division, Second Department, 1 A.D.2d 962, 150 N.Y.S.2d 356.
Lessee brought action against lessor and purchasers of leased realty from the lessor for specific performance of option clause in lease. The purchasers brought a landlord and tenant summary proceeding against the lessee for recovery of rent, on ground that purchasers were landlords by virtue of the purchase. The action and the summary proceedings were consolidated.
The Supreme Court, Special Term, Nassau County, Charles, S. Colden, J., 208 Misc. 903, 145 N.Y.S.2d 62, dismissed the complaint for specific performance and granted judgment for rent due in the summary proceeding, and the lessee appealed.
The Appellate Division, 1 A.D.2d 962, 150 N.Y.S.2d 356, affirmed the judgment and held that the option was unenforceable where lessor sold entire lot of which demised premises were only a part. Murphy and Kleinfeld, JJ., dissented.
The lessee appealed to the Court of Appeals, contending that the statute of frauds was not an adequate defense, that the option was in effect and binding when the purchasers purchased, and that option was first to be tendered for all of the lessor's property or that portion set forth in the lease.
