Appellant has presented a motion asking that the opinion be amended by striking the last paragraph thereof, which granted a new trial.

The motion is granted and the opinion amended by striking the paragraph to which reference had just been made, and by inserting in lieu thereof the following: 'The judgment is reversed with instructions to dismiss the action.'
