Appeal from Supreme Court, Appellate Division, First Department, 18 A.D.2d 971, 238 N.Y.S.2d 260.

Action for judgment declaring whether Motor Vehicle Accident Indemnification Corporation or automobile owner and his insurer should meet and defend claim of plaintiffWho was injured when driver to whom borrower of automobile loaned vehicle was driving.

The Supreme Court, New York County, Henry Clay Greenberg, J., rendered judgment for plaintiffs, and an appeal was taken.

The Appellate Division (Steuer, J., dissenting) affirmed, holding that evidence supported finding that unlicensed driver to whom borrower loaned automobile was driving with implied consent of owner when plaintiff was injured, and a further appeal was taken.
