The Appellate Division reversed on ground that the Special Term lacked power to consolidate the three proceedings in absence of action pending, and an appeal was taken.
Order of the Appellate Division reversed and that of Special Term reinstated, with costs in this Court and in the Appellate Division, upon the dissenting opinion at the Appellate Division.
