Appeal from County Court, Saratoga County.
The defendant was convicted in the Police Court of the Village of South Glens Falls, Vernon N. Green, J., of disorderly conduct in violation of Subdivision 1 of Section 722 of the Penal Law, Consol.Laws, c. 40, and he appealed.
The County Court, Saratoga County, affirmed the judgment of conviction.
The defendant appealed to the Court of Appeals, contending that the information was insufficient, on ground that no depositions or other supporting documents were attached or referred to therein, and that the information did not allege facts with sufficient clarity to properly inform defendant of the nature of the charges against him, and that the court did not have jurisdiction of the person of the defendant because he was arrested without a warrant, and that the court erroneously permitted the prosecution of the action by a person not duly authorized to prosecute the action when the court permitted the village attorney to prosecute the action.
