The Missouri courts and the overwhelming weight of authority hold that insanity excuses notice and proof of total and permanent disability where such are required by policies of insurance whether as conditions precedent or subsequent, and, under such circumstances, disability payments are due from the time of disability. (1) By the provisions of the policy the furnishing of proof of disability of the insured was a condition precedent to liability of the insurer to waive premium payments and pay disability benefits.
